"Super Drunk" Laws and Elevated BAC
Our state recently added the "Super Drunk" law, which specifies a new category for drunk driving. You now qualify as "super drunk" if your BAC is 0.17% or above.
It is especially important that you have a skilled attorney on your side since the penalties for a "super drunk" conviction are more serious than a regular DUI.
If you are convicted of driving with a BAC of 0.17% or higher, you can receive up to 180 days in jail, a fine between $200 and $700, license suspension for one year, 360 hours of community service, six points on your driving record and a mandatory alcohol treatment program for one year.
